The combination placed regulatory uncertainty and monetary-policy risk at the center of market positioning, with both major cryptocurrencies initially extending losses before recovering modestly during early U.S. trading.

Bitcoin opened at $75,586.51, representing a 3.3% decline from Tuesday’s opening price. By 7:12 a.m. ET, it had recovered to $75,885.53, indicating some stabilization after the initial move lower.

Ethereum Underperforms Bitcoin as Selling Pressure Broadens

Ethereum experienced a deeper opening decline. The cryptocurrency started Wednesday at $2,397.64, down 4.6% from Tuesday’s opening level, before moving higher to $2,404.43 by 7:12 a.m. ET.

The larger percentage decline compared with Bitcoin reflects the broader sensitivity of major alternative cryptocurrencies to shifts in risk appetite and regulatory expectations. Ethereum’s market structure also remains closely connected to institutional products, decentralized finance and tokenization activity, areas where regulatory clarity can influence participation and operating costs.

The weakness was not limited to Bitcoin and Ethereum. Earlier Wednesday, XRP had fallen nearly 10% to around $1.30, while Solana declined roughly 5% to just above $97. The breadth of the decline suggested that investors were reducing exposure across the crypto complex rather than rotating simply between individual major tokens.

CLARITY Act Failure Removes a Major Regulatory Catalyst

The immediate catalyst was the Senate’s failure to advance the CLARITY Act in a 49-50 procedural vote. The legislation required 60 votes to proceed and was intended to establish a federal framework for digital assets while providing greater clarity over the respective roles of the SEC and CFTC.

For institutional investors, the setback matters because regulatory uncertainty affects more than token classifications. It can influence exchange operations, custody structures, token issuance, compliance costs and the willingness of traditional financial institutions to expand digital-asset services.

The market reaction was particularly visible in crypto-related equities, with Coinbase and Circle falling more sharply than major cryptocurrencies during Tuesday’s selloff. That divergence highlights how companies whose business models depend heavily on the U.S. regulatory framework can carry additional policy sensitivity.

Fed Decision Adds a Second Source of Market Uncertainty

The regulatory setback arrived immediately before the Federal Reserve’s September policy decision. Markets widely expected a 25-basis-point increase, which would have represented the first rate hike since July 2023. The prospect of tighter monetary policy added another constraint because higher interest rates can increase the relative appeal of yield-bearing traditional assets while tightening liquidity available for higher-volatility investments.

That dynamic was already visible across financial markets. The U.S. 10-year Treasury yield had moved above 5%, while geopolitical disruptions had pushed oil prices above $100 a barrel, reinforcing concerns about persistent inflation. For crypto investors, the combination created a difficult backdrop in which both regulatory expectations and macroeconomic conditions were moving in a less supportive direction.

What Crypto Markets Are Watching Next

The immediate focus was the Federal Reserve’s decision and subsequent guidance, particularly whether policymakers signaled additional tightening or a more cautious path after the expected increase. Beyond rates, investors will monitor Bitcoin’s ability to stabilize above the $75,000 area, institutional ETF flows and whether the CLARITY Act can return to legislative negotiations. The interaction between monetary liquidity, regulatory uncertainty and institutional demand is likely to remain central to crypto market pricing.
