September 15 Becomes a Critical Test for Crypto Regulation

The Senate did not advance the CLARITY Act before its August recess, leaving the legislation facing an increasingly compressed timetable. Following pressure from President Donald Trump, Senate Majority Leader John Thune scheduled a cloture vote for September 15, one day after senators return.

Cloture would not itself enact the legislation. Instead, it would end debate and overcome a potential filibuster, clearing the path toward a subsequent formal vote. Because both cloture and final passage require 60 votes in the Senate, the September vote could provide one of the clearest indications yet of whether the bill has sufficient bipartisan support.

Armstrong’s Forecast Collides With Prediction-Market Pricing

Armstrong has expressed confidence that the bill can clear the threshold, arguing that Thune would not have scheduled the vote without believing the legislation had a viable path. He has also said that both political sides received approximately 90% of what they wanted during negotiations.

Kalshi traders are considerably less confident. The prediction market currently places the probability of the CLARITY Act receiving more than 60 votes at only 22%. That wide gap matters because it reflects two distinct assessments: Armstrong is emphasizing negotiations and legislative momentum, while prediction-market participants are pricing the remaining political obstacles.

The Senate Math Requires Democratic Support

The central challenge is straightforward. Republicans hold 53 Senate seats, leaving at least seven Democrats needed to reach the 60-vote threshold. Democratic lawmakers have raised concerns about ethics provisions governing politicians’ financial interests in cryptocurrency, particularly following President Trump’s reported crypto-related profits.

Banking groups have also pushed back on aspects of the bill’s stablecoin provisions. While the legislation would prohibit idle stablecoins from earning yield, it would permit certain rewards tied to activities such as transactions. Financial institutions have argued that the framework may not provide sufficient safeguards for traditional banking models.

Why the Bill Matters to Crypto Markets

The CLARITY Act could establish a broader federal framework for digital assets while addressing the longstanding question of which regulator has authority over different segments of the crypto market. Under the proposed framework, the CFTC would receive exclusive jurisdiction over spot markets for digital commodities, while the SEC’s role would remain focused on assets and activities falling within securities regulation.

For Coinbase and other major crypto platforms, clearer jurisdiction could reduce regulatory uncertainty surrounding listings, trading and institutional services. For investors, the legislative outcome could influence how capital flows into digital assets and how financial institutions structure their crypto businesses.

The immediate focus is therefore on the September 15 cloture vote. A 60-vote result would represent meaningful legislative momentum, but it would not guarantee final passage. Conversely, failure to reach the threshold would reinforce concerns that the industry remains divided from Washington on key issues. Until senators vote, the contrast between Armstrong’s optimism and Kalshi’s 22% pricing remains one of the clearest indicators of how uncertain the bill’s path has become.
