Regulation Emerges as Hyperliquid’s Biggest Risk

Hyperliquid’s rapid growth has strengthened its position among decentralized trading platforms, but regulatory uncertainty remains its most significant potential vulnerability, according to Crypto Banter founder Ran Neuner.

Speaking on Cointelegraph’s Chain Reaction podcast, Neuner argued that regulators have largely focused on establishing frameworks for centralized cryptocurrency exchanges and could increasingly turn their attention toward decentralized platforms.

The uncertainty surrounding how authorities will classify and regulate decentralized exchanges creates a potentially significant risk for Hyperliquid, particularly as the platform continues expanding its trading activity and user base.

Neuner pointed to the European Union’s Markets in Crypto-Assets regulation, or MiCA, as an example of the regulatory frameworks already being established for centralized crypto businesses.

His concern is that decentralized exchanges could become the next major focus of regulatory authorities once rules governing centralized platforms become more established.

Hyperliquid Builds a Network-Effect Moat

While Neuner highlighted regulation as the platform’s primary vulnerability, he was considerably more optimistic about Hyperliquid’s competitive position.

Hyperliquid is a layer-1 blockchain best known for its decentralized perpetual futures exchange. According to DeFiLlama data, the platform recorded approximately $223 billion in trading volume over the previous 30 days, making it a leading venue in the decentralized perpetuals market.

Neuner argued that Hyperliquid benefits from network effects that competitors cannot easily reproduce by copying its underlying technology.

The advantage is particularly relevant in trading, where liquidity tends to attract additional users. Deeper liquidity can make it easier for traders to enter and exit positions while potentially improving the overall trading experience.

As more traders use a platform, liquidity can deepen further, reinforcing the platform’s position and creating a barrier for new competitors.

US Access Could Create a Regulatory Pathway

Despite the regulatory concerns, Hyperliquid could potentially gain access to the US through a compliant framework.

President Donald Trump said in August that Commodity Futures Trading Commission Chair Michael Selig was working to bring Hyperliquid into the US in a “fully compliant and legal fashion.”

The remarks triggered a sharp rally in HYPE, which gained approximately 20% over the 24-hour period surrounding the announcement and traded near $70 at the time.

However, neither the CFTC nor Hyperliquid had publicly released a formal proposal explaining how US access would operate, whether an application had been submitted or when a compliant service could become available.

HYPE Extends Its 2026 Rally

HYPE has continued to perform strongly following the August announcement.

On Friday, the token was trading around $82, representing a gain of more than 220% since the beginning of the year, according to CoinGecko.

Its market capitalization stood at approximately $18.2 billion, while its fully diluted valuation was around $78.4 billion.

The valuation reflects the market’s growing expectations surrounding Hyperliquid’s trading ecosystem and potential expansion, although regulatory developments remain an important variable for the network and its token.

Outlook

Hyperliquid’s combination of high trading volumes, liquidity and network effects provides a substantial competitive advantage, but regulatory treatment could ultimately prove more consequential than technological competition. A compliant path into the US would potentially expand the platform’s addressable market, while restrictive rules for decentralized exchanges could introduce significant operational and market-access challenges. As regulators increasingly examine decentralized financial infrastructure, Hyperliquid’s ability to navigate that environment may become as important to its long-term growth as its trading technology.
