XRP extended its recent decline after the U.S. Senate failed to advance the CLARITY Act before lawmakers began their August recess, delaying one of the cryptocurrency industry’s most closely watched regulatory proposals until at least September 14. The setback comes as digital asset markets continue to balance improving institutional adoption against persistent regulatory uncertainty in the United States.

The legislative delay has weighed particularly heavily on XRP, whose regulatory status has remained a central issue since Ripple’s multi-year legal battle with the U.S. Securities and Exchange Commission (SEC). While Bitcoin and other major cryptocurrencies continue to attract institutional inflows, XRP investors are once again confronting uncertainty over the asset’s long-term legal framework.

Legislative Delay Pressures XRP Price

Senate Majority Leader John Thune did not file the cloture motion required to bring the CLARITY Act to a Senate vote before Congress entered recess. As a result, consideration of the bill has been postponed until lawmakers return on September 14.

The market reaction was immediate. XRP has declined approximately 4.5% this month, trading near $1.04 and hovering just above the psychologically important $1.00 support level. The delay reinforces the market’s sensitivity to regulatory developments, particularly for digital assets whose legal classifications remain subject to evolving federal policy.

CLARITY Act Viewed as Key to Regulatory Certainty

The proposed CLARITY Act is designed to establish a comprehensive federal framework governing digital assets in the United States. Earlier this year, the SEC and the Commodity Futures Trading Commission (CFTC) jointly classified XRP as a digital commodity. However, because that designation was made through regulatory action rather than legislation, future administrations or regulators could potentially revise the classification.

Supporters argue that codifying digital commodity status into federal law would provide greater certainty for institutional investors, exchanges, and blockchain developers. Political disagreements have slowed the bill’s progress, with Democratic lawmakers raising ethics concerns tied to President Donald Trump’s reported cryptocurrency-related income during 2025, while Republicans continue seeking broader bipartisan support.

Investor Expectations Shift Sharply

Prediction market data reflects a significant deterioration in expectations for near-term legislative progress. According to Polymarket, traders now assign only a 14% probability that the CLARITY Act will become law this year, a sharp decline from approximately 82% in February.

The shift illustrates how regulatory expectations continue to influence digital asset valuations beyond traditional market fundamentals. Following Ripple’s partial legal victory in 2023, which determined that XRP sales on public exchanges did not constitute securities transactions, many investors anticipated a clearer legislative framework. The current delay has instead prolonged uncertainty, contributing to cautious market positioning.

Regulation Remains a Core Driver for XRP

Unlike many digital assets whose price movements are driven primarily by macroeconomic conditions or blockchain adoption metrics, XRP’s valuation remains closely linked to regulatory developments. The cryptocurrency spent more than two years absent from many major U.S. trading platforms before exchange relistings resumed following the court ruling against the SEC’s broader claims.

That history explains why legislative developments continue to command outsized attention among institutional investors. Greater regulatory clarity could expand participation from financial institutions, while continued delays may encourage investors to remain defensive until a more predictable legal framework emerges.

Looking ahead, market participants will closely monitor the Senate’s return in mid-September for signs that the CLARITY Act can regain legislative momentum. Until then, XRP’s performance is likely to remain influenced by broader cryptocurrency market conditions, regulatory headlines, and evolving expectations surrounding U.S. digital asset legislation. For institutional investors, the next phase of the regulatory process may prove as significant as macroeconomic developments in determining XRP’s medium-term outlook.
