The US Senate’s failure to advance the CLARITY Act has created different implications for publicly traded crypto companies, with Coinbase facing particularly direct exposure because of its dependence on cryptocurrency trading activity.
In a Wednesday note, Saxo Bank strategist Ruben Dalfovo said Coinbase is more directly affected by developments surrounding the legislation because market-structure rules could determine which assets are permitted to trade, how platforms must register and which participants can operate in US crypto markets.
“Coinbase is most exposed to clearer market rules because trading and crypto participation directly affect its business,” Dalfovo wrote.
The assessment places Coinbase’s core trading operations at the center of the debate over how the US ultimately establishes a regulatory framework for digital assets.
Saxo distinguished Coinbase’s exposure from that of Circle and Strategy, two other major publicly traded companies in the digital-asset sector.
Circle’s business is more closely connected to the adoption of its USDC stablecoin and the interest generated from the reserves supporting the token. Changes in stablecoin regulation and market adoption therefore represent a different channel through which US policy can affect the company.
Strategy, meanwhile, has a business model centered heavily on its Bitcoin holdings and financing structure. Its exposure to the CLARITY Act therefore differs from an exchange whose revenue is directly linked to trading activity and participation in US crypto markets.
Despite these differences, shares of Coinbase, Circle and Strategy all declined between 5% and 10% following Tuesday’s Senate procedural vote, according to the source report.
The selling continued into early Wednesday, with the three companies reported to be down between 2% and 6%.
The CLARITY Act failed to clear a key procedural hurdle on Tuesday when senators voted 49-50 against invoking cloture on a motion to proceed to the legislation.
The procedural vote required 60 votes. Failure to invoke cloture prevented the Senate from moving forward under the proposed process and represented a significant setback for the legislation.
The bill has faced opposition over several provisions, including ethics-related measures. Last-minute concessions were aimed at addressing concerns surrounding cryptocurrency interests held by public officials, but those changes were not sufficient to secure the required support for the procedural vote.
The timing of the setback is also significant.
The Senate’s 2026 legislative calendar provides a relatively limited window for lawmakers to revisit the legislation before the November 3 midterm elections and the planned December 18 adjournment.
That leaves a narrower period for the CLARITY Act to return to the legislative agenda during the current congressional session.
For crypto exchanges and other digital-asset businesses operating in the United States, the delay means that questions around market structure, registration requirements and the regulatory treatment of different crypto assets remain unresolved.
The CLARITY Act setback leaves Coinbase particularly exposed to continued uncertainty because its core trading operations are directly connected to the regulatory structure governing US crypto markets. Circle and Strategy face different policy and market sensitivities based on their respective business models. With the Senate vote having stalled the legislation and the remaining 2026 legislative calendar relatively constrained, market participants will continue to watch for further congressional action and developments affecting US digital-asset market rules.
